Terms of Use

Effective 15 May 2026

Draft — review with a lawyer before publishing.

This document is a starting template and does not constitute legal advice. Please have a qualified legal professional review the contents and tailor them to your jurisdiction and operations before relying on it.

1. Acceptance

By creating an account, registering as a player, or otherwise using the TBC Cricket Club website and player-management application (the "Service"), you agree to be bound by these Terms of Use (the "Terms") and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 16 years of age to register, or have the consent of a parent or guardian if you are younger. By registering, you confirm that the information you provide is accurate and that you are authorised to provide it.

3. Your account

You are responsible for keeping your account credentials secure. Do not share your sign-in code or session with anyone else. Notify us promptly if you believe your account has been accessed without your permission.

4. Acceptable use

  • Use the Service only for its intended cricket club purposes.
  • Provide accurate, up-to-date information when registering and updating availability.
  • Do not impersonate others, submit fraudulent registrations, or attempt to access another player's account.
  • Do not upload offensive, infringing, or otherwise unlawful content (including profile photos).
  • Do not attempt to disrupt the Service, probe for vulnerabilities without authorisation, or extract data at scale.

5. On-field play and physical safety

The Service helps coordinate fixtures and availability — it is administrative software, not a substitute for safe cricket practice. Participation in cricket matches and training carries inherent risks of injury. You acknowledge that you participate at your own risk and that the operators of the Service are not responsible for on-field injuries, equipment failures, or the conduct of other participants. Any separate league waiver or member agreement you have signed continues to apply.

6. Content you submit

You retain ownership of the content you submit (such as profile photos and notes). By submitting content, you grant us a non-exclusive, royalty-free licence to use it solely for the purpose of running the Service and the season — for example, displaying your photo on team rosters and within club-facing reports.

7. Intellectual property

All other content on the Service — including the design, code, club marks, and aggregated statistics — is owned by TBC Cricket Club or its licensors and is protected by intellectual-property laws. You may not copy, modify, or redistribute it without permission.

8. Suspension and termination

We may suspend or terminate access to the Service at any time, with or without notice, if you breach these Terms, if your conduct is harmful to other players, or if we are required to do so by law. You may stop using the Service at any time by contacting us at hello@legumpire.com to request account deletion.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will be permanently retained.

10. Limitation of liability

To the maximum extent permitted by law, TBC Cricket Club and its volunteers, contractors, and processors shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising out of your use of the Service. Some jurisdictions do not allow these limitations; in those cases, our liability is limited to the smallest extent permitted by applicable law.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified to registered players by email or via an in-app notice. Continued use of the Service after the effective date of the new Terms constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Australia. Any disputes arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, unless required otherwise by mandatory local consumer protection laws.

13. Contact

Questions about these Terms can be sent to hello@legumpire.com.
